It is worth not\u00ading that though there are mil\u00adlions of Islam\u00adic faith\u00adful in the U.S., only two took the \u201cDraw the Prophet\u201d con\u00advo\u00adca\u00adtion as an incite\u00adment to vio\u00adlence. The Court is expect\u00aded to hold that it does, a rather remark\u00adable rever\u00adsal in a remark\u00adably short peri\u00adod of time.<\/p>\n Just two years ago, the Court wrote that states alone had author\u00adi\u00adty to define and reg\u00adu\u00adlate mar\u00adriage, includ\u00ading lim\u00adit\u00ading it to het\u00adero\u00adsex\u00adu\u00adal cou\u00adples (U.S. v. Wind\u00adso<\/em>r<\/a>,<\/span> slip opin\u00adion at pages 14, 17 and 18). In strik\u00ading down a pro\u00advi\u00adsion of the Defense of Mar\u00adriage Act, the Court held that states have pri\u00adma\u00adcy in defin\u00ading mar\u00adriage and that the fed\u00ader\u00adal gov\u00adern\u00adment had to assume a sub\u00adservient role, accept\u00ading the valid\u00adi\u00adty of any mar\u00adriage licensed by any state. Next month, it is expect\u00aded to hold that the fed\u00ader\u00adal Con\u00adsti\u00adtu\u00adtion requires every state to accept the valid\u00adi\u00adty of same-sex mar\u00adriages, turn\u00ading the pri\u00adma\u00adcy of state law artic\u00adu\u00adlat\u00aded in Wind\u00adsor <\/em>on its head.<\/p>\n A brief<\/a> filed by one of the cou\u00adples urg\u00ading this result assert\u00aded that mar\u00adriage is \u201ca foun\u00adda\u00adtion\u00adal means in our soci\u00adety of seek\u00ading per\u00adson\u00adal ful\u00adfill\u00adment and acquir\u00ading com\u00admu\u00adni\u00adty esteem.\u201d Mar\u00adriage, they argue, exists to make me feel good about myself and to com\u00adpel the gov\u00adern\u00adment to authen\u00adti\u00adcate my feelings.<\/p>\n Mar\u00adriage did\u00adn\u2019t used to be viewed as a form of self-expres\u00adsion. It was under\u00adstood, not as the enlarge\u00adment of rights, so much as their relin\u00adquish\u00adment. Tra\u00addi\u00adtion\u00adal vows were pledges of self-denial, to place the good of anoth\u00ader above one\u2019s own even \u2013 espe\u00adcial\u00adly \u2013 when cir\u00adcum\u00adstances sour. The government\u2019s inter\u00adest in rec\u00adog\u00adniz\u00ading mar\u00adriage has not been to val\u00adi\u00addate and affirm love and emo\u00adtion, but to pro\u00adtect the well-being of chil\u00addren who are the prod\u00aduct of pro\u00adcre\u00adative union.<\/p>\n The Court appears head\u00aded toward pro\u00adclaim\u00ading what Jus\u00adtice Brey\u00ader dur\u00ading oral argu\u00adments termed a fun\u00adda\u00admen\u00adtal \u201cright to be mar\u00adried,\u201d an indi\u00advid\u00adual pre\u00adrog\u00ada\u00adtive whose exer\u00adcise states are con\u00adsti\u00adtu\u00adtion\u00adal\u00adly oblig\u00aded to recognize.<\/p>\n In so doing, the Court will be accu\u00adrate\u00adly reflect\u00ading, not only pop\u00adu\u00adlar atti\u00adtudes toward mar\u00adriage but toward life more gen\u00ader\u00adal\u00adly. Self-absorp\u00adtion, once con\u00adsid\u00adered a vice, is com\u00ading to be viewed as life\u2019s high\u00adest pur\u00adpose, the goal of the unend\u00ading pur\u00adsuit of gratification.<\/p>\n That is now our pre\u00advail\u00ading cul\u00adtur\u00adal out\u00adlook, as evi\u00addenced in a thou\u00adsand ways, includ\u00ading the sep\u00ada\u00adra\u00adtion of child\u00adbear\u00ading from mar\u00adriage. We are told that het\u00adero\u00adsex\u00adu\u00adal\u00adi\u00adty and homo\u00adsex\u00adu\u00adal\u00adi\u00adty are bio\u00adlog\u00adi\u00adcal\u00adly deter\u00admined but that gen\u00adder is not. At least that appears to be the mes\u00adsage of Bruce Jen\u00adner, the real\u00adi\u00adty show celebri\u00adty who is pay\u00ading doc\u00adtors a good deal of mon\u00adey to change him from an old man into an old woman, and in the process win him at least a few more years of the pub\u00adlic atten\u00adtion he craves.<\/p>\n Jenner\u2019s sur\u00adgi\u00adcal and hor\u00admon\u00adal trans\u00adfor\u00adma\u00adtion is con\u00adceived as an act of self-actu\u00adal\u00adiza\u00adtion, lib\u00ader\u00adat\u00ading his inner being from bio\u00adlog\u00adi\u00adcal shack\u00adles. Yet adher\u00adents to Islam may ulti\u00admate\u00adly derive some ben\u00ade\u00adfit from the Court\u2019s ruling.<\/p>\n The lawyer argu\u00ading the same-sex mar\u00adriage case before the Supreme Court fum\u00adbled the ques\u00adtion of whether states were con\u00adsti\u00adtu\u00adtion\u00adal\u00adly required to sanc\u00adtion polyg\u00ada\u00admous mar\u00adriages. She argued that states could refuse to grant licens\u00ades to any\u00adone but cou\u00adples because polyg\u00ada\u00admous divorce would cause \u201clots of fam\u00adi\u00adly dis\u00adrup\u00adtion issues<\/a>,<\/span>\u201d cit\u00ading vis\u00adi\u00adta\u00adtion rights as an exam\u00adple. Divorce almost invari\u00adably caus\u00ades dis\u00adrup\u00adtion, but that does not autho\u00adrize a state to deny some\u00adone\u2019s \u201cright to mar\u00adry.\u201d If the Court holds that peo\u00adple have a right to the \u201cper\u00adson\u00adal ful\u00adfill\u00adment\u201d and \u201ccom\u00admu\u00adni\u00adty esteem\u201d con\u00adferred by mar\u00adriage, then it needs a far more com\u00adpelling rea\u00adson than \u201cfam\u00adi\u00adly dis\u00adrup\u00adtion\u201d to lim\u00adit mar\u00adriage to two peo\u00adple at a time. Gov\u00adern\u00adment can\u2019t impose a quo\u00adta on love.<\/p>\n Accord\u00ading to Gallup, 3.6 per\u00adcent<\/a> of the U.S. pop\u00adu\u00adla\u00adtion are gay or les\u00adbian, which makes them rather a tiny minor\u00adi\u00adty. At one per\u00adcent<\/a> of the pop\u00adu\u00adla\u00adtion, Mus\u00adlims are even less numer\u00adous than gays and arguably more reliant on the courts to vin\u00addi\u00adcate their rights.<\/p>\n The Prophet Muham\u00admad had sev\u00ader\u00adal wives<\/a>.
